MICRO ENTITY FEES, AIA, USPTO
Another provision related to the fee-setting authority is the micro-entity status. For those who qualify under the micro entity status, a 50% discount is applied to USPTO fees. This provision is not expected to go into effect until 2013.
To qualify for the micro-entity status, your income must fall below $149,331 dollars. This amount is actually calculated as three times the median income which is reported on the US Census website. As of 2009, the median income was $49,777.
Also, you must have not filed more than 4 nonprovisional patent applications, and have not entered into a licensing agreement with a person or entity who does not also qualify for the micro entity status.
Another provision is Priority Examination, or Track 1, which allows for accelerated examination. Under this system, you may have your final decision on your patent application within 1 year. This will essentially place your application to the front of the line. It will set you back around $4,000 for large entities, $2,000 for small entities, and $1,000 for micro-entities.
