AIA: FIRST TO FILE PROVISION
Perhaps the most important and controversial provision of the Patent Reform Act is the first to file system. Under the new first to file system, the USPTO will only grant patents to the first inventor to file a patent application with the USPTO, as opposed to the person who may have actually come up with that idea beforehand, but got beat to the patent office. This provision is not expected to go into effect until sometime in 2013.
